Usage and Privacy Policy

Introduction to the Terms of Use Agreement: We welcome you to the online store and inform you that below you will find the terms and conditions governing your use of this store, and all legal effects arising from your use of the store's services via this online platform. Any person's use of this store — whether as a consumer of a service or product of the store or otherwise — constitutes acceptance and consent on their part, made with full legal capacity as recognized by Sharia, regulation, and law, to all clauses and provisions of this Agreement, and confirms their commitment to what is required and stated herein. This Agreement applies to all forms of dealings between the consumer and the store, and is considered valid and effective upon your consent and the start of registration with the store, pursuant to Article Ten of the Saudi E-Transactions Law.

Article One – Introduction and Definitions: The preamble above is considered an integral part of this Agreement. Below are the meanings and definitions of the key terms used in this Agreement:

1. The Store: This term includes all forms of the store on the internet, whether an electronic application, a website, or a physical shop.
2. The Consumer: The person who deals in e-commerce seeking to obtain the products or services provided by the store through its electronic platform.
3. The Agreement: Refers to the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.

Article Two – Consumer's Legal Capacity:

1. The consumer acknowledges that they possess legal capacity recognized by Sharia and regulation to deal with the store, or that they are not less than eighteen years of age.
2. The consumer agrees that, should they violate this article, they shall bear the consequences of such violation before others.

Article Three – Nature of the Obligation:

1. The store's obligation toward consumers is to provide the (service or product).
2. The store may provide other after-sales services or other related services, depending on the nature and type of the (service or product) requested by the consumer.

Article Four – Usage Controls:

1. The consumer shall use the store's electronic platform in accordance with public decency and the regulations in force in the Kingdom of Saudi Arabia.
2. The consumer shall not, when purchasing a service or product from this store, use that service or product in any manner that violates public decency and the regulations in force in the Kingdom of Saudi Arabia.

Article Five – Accounts and Registration Obligations: Upon applying to join this store's membership as a user, you are obligated to disclose specific information and choose a username and a confidential password to use when accessing the store's services.

By doing so, you agree to the following:

1. You are responsible for maintaining the confidentiality of your account information and password, and you agree to notify the store immediately of any unauthorized use of your account information or any breach of confidentiality.
2. The store shall under no circumstances be responsible for any loss you may incur, directly or indirectly, morally or materially, as a result of the disclosure of your username or password.
3. You agree to use your account or membership with the store personally, as you bear full responsibility for it. If someone else uses it, this shall be considered evidence that you authorized them to use the store and your account.
4. You agree to use the store seriously and honestly at all times.
5. You agree to disclose accurate, correct, and specific information about yourself during registration with the store, and to update your information whenever it changes in reality or whenever necessary.
6. Our store is committed to handling your personal information and contact details with strict confidentiality.
7. If the store determines that you have disclosed inaccurate, unverified, incomplete, or unlawful information, the store reserves the right to cancel your membership or account.
8. In the event of non-compliance with any of the above articles, the store's management has the right to suspend or cancel your account or membership, or to bar you from accessing the store's services again.

Article Six – Electronic Communications and Official Channels of Communication:

1. The parties to this Agreement agree that communication shall take place via the email address registered on the platform.
2. The consumer agrees that all agreements, notices, data, and other communications delivered electronically satisfy any written-form requirements and stand as valid evidence in themselves, fulfilling both regulatory and Sharia requirements.
3. The consumer agrees to the possibility of being contacted and notified of any provisions related to this Agreement or to their dealings with the store, whether through general messages sent to all consumers or through messages sent to specific users of the store.

Article Seven – Amendments to the Terms of Use and Fees:

1. If any article or clause of this Agreement is deemed void or is found not to be part of this Agreement, that shall not affect the validity of the remaining articles and clauses, nor shall it affect the store's other lawful means of recovering its rights from consumers.
2. This Agreement — which may be amended from time to time as circumstances require — constitutes the working mechanism and mutual understanding and agreement between the (consumer) and the (store).
3. The store may charge fees to certain consumers depending on the products or services they request, or other charges may apply, such as fees or taxes based on the nature of the product or service.
4. The store reserves the right to increase, decrease, or limit any fees in a manner consistent with the articles, clauses, and provisions of this Terms of Use Agreement, applicable to all registered consumers.

Article Eight – Payment and Settlement Services via the Store:

1. The store provides, through its partners, an online payment and settlement system through the payment options available on the store, or through any other payment method the store may provide from time to time.
2. The store shall provide the price of the service or product it offers based on recognized market value.
3. The store shall provide means of payment and settlement that ensure the receipt of all amounts and revenues generated through it, and shall ensure that a purchase invoice is issued for each service or product.
4. The store shall provide the accounting disclosures recognized for electronic stores, in application of the provisions of this Agreement and in consideration of the legal, economic, commercial, and regulatory interests involved.

Article Nine – Intellectual Property:

1. All intellectual property rights belonging to the store are fully owned by the store, whether they were owned before or after the establishment of this electronic platform.
2. The consumer shall respect the store's intellectual property rights, including but not limited to the store's name, words, logos, and symbols belonging to or displayed on the store — all of which constitute fully protected intellectual property rights of the store.

Article Ten – Store's Responsibility:

1. The store shall conduct its commercial activity through the electronic platform in a lawful manner, in accordance with the regulations in force in the Kingdom of Saudi Arabia and the provisions of this Agreement.
2. The store shall not bear any claims arising from errors or negligence, whether direct or indirect, on the part of the consumer or on the part of a third party such as shipping companies.
3. (MSD1983), its staff, and its representatives are committed to ensuring that the (store or service) is sound, legitimate, and authorized, in a manner that serves the benefit of the Kingdom of Saudi Arabia and is used for lawful purposes.

Article Eleven – Restriction of Access or Membership: The store may suspend or cancel a consumer's membership or access to the platform's services at any time, without giving any reason and without prior notice.

Article Twelve – Governing Law and Applicable Regulations: This Terms of Use Agreement is governed by and formulated in accordance with the laws, regulations, and legislation applicable and in force in the Kingdom of Saudi Arabia, and is fully and entirely subject to the regulations applied by the authorities in the Kingdom of Saudi Arabia.

Article Thirteen – General Provisions:

1. If any article or clause of this Agreement is voided or found not to be part of it, this shall not affect the remaining articles and clauses, as determined by the store's management. Voiding of any article or clause under such circumstances shall not be considered grounds for its removal or translation into another language.
2. All prices displayed for the store's services or products may be amended from time to time.
3. Any promotional or marketing offers made by the store are temporary, and the store has the right to modify or discontinue them at any time.
4. The parties to this Agreement shall conduct themselves in a manner that does not violate Sharia principles, regulations, and laws in force.
5. This Terms of Use Agreement may only be revoked by a decision issued by the store's management.
